PLEASE READ THE TERMS OF USE CAREFULLY BEFORE USING THIS WEBSITE. YOUR USE OF THE WEBSITE OR THE PRODUCTS AND SERVICES PROVIDED BY THE WEBSITE SHALL IMPLY YOUR ACCEPTANCE OF THE TERMS OF USE AND YOUR AGREEMENT TO BE LEGALLY BOUND BY THE SAME.

This Terms of Use Agreement is a legal agreement between the users of the Website (“User” or “You” or “Your”) and LaurenAnn, which company is the exclusive owner of the trade name “LaurenAnn Kids Boutique” (“Company” or “LaurenAnn”). This Agreement provides among other things, the terms and conditions for your access to and use of this website https://www.laurenann.in  ( the “Site” or “Website”).

You are requested to carefully go through the Terms of Use and the privacy policy available at https://www.laurenann.in/Privacy Policy before you access the Website or avail the Services made available on the Website by the Company. These Terms of Use and the Privacy Policy together constitute a legal and binding agreement (“Agreement”) between you and the Company in relation to your visit to the Website and your use of the Services.

The Agreement applies to you if you are –

1. A business entity/organization that legally operates in India or in any other country, uses the Services provided by the Company and can form legally binding contracts under the applicable law (“you” or “User”).
2. An individual who is not a minor as per applicable law, who is eligible to use the Services (“you” or “User”).
3. Otherwise, a visitor and/or user of the Website (“you” or “User”).

LaurenAnn reserves the right to change or revise the Terms at any time by posting changes or a revised Terms of Use on this Website, including by way of imposing any charge for access to or use of the Website. The changed or revised Terms will be effective immediately after it is posted on this Website. Your use of the Website following the posting of any such changes will constitute Your acceptance of the revised Terms.

LaurenAnn encourages You to review the Terms whenever You visit the Website to make sure You understand the Terms governing the use of the Website. If You do not agree to the Terms, please immediately terminate Your use of the Website.

WEBSITE USE:

1. All products, services, and information displayed on the Website constitute an “invitation to offer”. Your order constitutes Your “offer” which shall be subject to the Terms as listed here. LaurenAnn reserves the right to accept or reject Your offer. If You have supplied us with Your e-mail address, we will notify You by e-mail as soon as possible to confirm receipt of Your order. Our acceptance of Your order will take place upon dispatch of the product(s) ordered. No act or omission of LaurenAnn prior to the actual dispatch of the product(s) ordered will constitute LaurenAnn’s acceptance of Your offer.
2. Products and services are not available to minors. If You are below 18 years of age, You may use the Website only with involvement of a parent or guardian. It shall be Your responsibility to ensure that You are of legal age to form a binding contract and are not barred under the laws as applicable in India.
3. LaurenAnn retains the right to deny access to the Website to any new User(s) or terminate access granted to any existing User(s) at any time for any reason, without providing any reasons.
4. You are responsible for maintaining the necessary computer equipment and Internet connection that may be required to access, use, and transact on the Website.

INTELLECTUAL PROPERTY RIGHTS

1. Unless otherwise stated, We shall own all right, title and interest, including all related intellectual property rights like source code, databases, software, applications, audio, text, images, graphics, trademarks, service marks, etc.
2. Third party trademarks may appear on this Platform and all rights therein are reserved to be registered owners of those trademarks. For use of any third party’s intellectual property, User needs to get permission directly from the owner of the intellectual property for any use.
3. The Terms do not constitute a sale and do not convey to the User any rights of ownership in or related to the Platform or the goods or services, or any intellectual property rights owned by the Company. The User shall be solely responsible for any violations of any laws and for any infringement of any intellectual property rights.

 

LaurenAnn respects the intellectual property of others. If You believe Your work has been copied in a way that constitutes an Intellectual Property Right infringement, please address a complaint to support@laurenann.in

PRICES AND DELIVERY CHARGES

1. The product prices in the Online Store are inclusive of applicable statutory tax or Goods and Services Tax (GST) and delivery charges for Indian customers.

1. The prices in the Online Store may differ from those in our physical stores. The delivery charges differ country-wise.

1. We may offer promotions, discount codes, gifts, etc. from time to time. These offers are valid only for the specified period and on the terms directly associated with them. These offers do not combine with other discounts unless expressly stated otherwise in the Online Store. In order to use the offer, you need to fill in the discount code, applicable to the offer, before completing the purchase.

PAYMENT

We accept the following forms of payment:

Visa, Mastercard, Net banking, Cash on delivery, Rupay

For all transactions made via the Platform, You agree to provide present, full, and correct payment and account details. You will agree to keep Your account and payment records up to date, including Your email address and payment card expiration date, if applicable.

CANCELLATION POLICY

The User can cancel the order at any time before the delivery of the products, within 24 hours of placing the order and the refund shall be initiated as per the Refund Policy as stated in the succeeding clause. The User shall make sure that he/she does not accept the order, in case a delivery attempt was made for a cancelled order.

PRIVACY:

Use of this Website is governed by our Privacy Policy. You confirm that You have read and fully understand the Privacy Policy of the Website and the Terms are acceptable to You.

MEMBERSHIP ELIGIBILITY:

1. The use of the Website is available only to persons who can form legally binding contracts under applicable law. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including undischarged insolvents etc. are not eligible to use the Website.
2. If Your age is below 18 years, your parents or legal guardians can transact on behalf of You if they are registered users. LaurenAnn reserves the right to terminate Your membership and refuse to provide You with access to the Website if LaurenAnn discovers that You are under the age of 18 years.
3. LaurenAnn does not discriminate on the basis of age, gender, race, religion, caste, class, lifestyle preference, or nationality.

LIABILITY

1. It is expressly made clear to You that LaurenAnn does not manufacture any of the products that are listed on this Platform except those where LaurenAnn is mentioned as the Manufacturer
2. User understands, agrees and acknowledges that LaurenAnn is an intermediary and online e-commerce marketplace. The ‘contract for sale’ of the products, if any, shall be a bipartite contract between User and sellers enlisted on the Platform.
3. Any claim that the User may have with respect to the quality, appearance, nature, consumption, usage or any other attribute(s) of the products shall be pursued by the User directly with the seller and LaurenAnn shall not be made a party to any such claim. User hereby waives any claim and releases LaurenAnn from and against any and all liabilities, losses, claims, damages that may arise out of or in connection with the disclaimer as mentioned in the succeeding clause.

MODIFICATIONS TO THE SERVICE AND PRICES

• Prices for our products are subject to change without notice.
• We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
• We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Product Exactness

1. LaurenAnn will make every possible effort to showcase and describe the attributes of our products (measurements, composition, and colors) with the utmost accuracy. The color may differ with the device, while the measurements of the outfits are only approximate values that probably fit the model.
2. We do not guarantee the actual measurements of the product you receive, since the final measurements vary with the material being used. If you are dissatisfied with the received product, you may return it. Check out the Return & Refund Policy section.

Pricing Error and Discrepancy

1. Pricing on the product and service is as it shows, however on occasions due to any technical issue or typographical error the actual product or service price may vary. If LaurenAnn comes across any such difference in pricing, it has all the rights to rectify the same or cancel the order.
2. If a product or service’s correct price is lower than the Website stated price, LaurenAnn will charge the lower amount and send You the product or service. If a product or service’s correct price is higher than the Website stated price, LaurenAnn will cancel Your order and notify You of that cancellation.
3. The product or service price mentioned on the Website is the Maximum Retail Price (MRP) for the said product or service. Such MRP shall be inclusive of all local taxes as are applicable in India. Additional applicable taxes may be charged depending upon the destination where the order has to be shipped to. The tax rate applied and charged upon the order shall include combined tax rate for both state and local tax rates in accordance with the address where the order is being shipped.
4. LaurenAnn reserves the right to collect taxes and/or such other levy/ duty/ surcharge that it may have to incur in addition to the normal taxes it may have to pay. We may also charge delivery charges which may include postal/shipping charges to deliver the product or services ordered by You on the Website.

Force Majeure/Act of God

Failure on the part of LaurenAnn to perform any of its obligations and the inability to provide a product or service shall not entitle You to raise any claim against LaurenAnn or be a breach hereunder to the extent that such failure arises from an event of Force Majeure or Act of God. Situations include but not limited to any war, civil commotion, strike, governmental action, lockout, accident, epidemic, any defect or delay caused due to the server, internet, technical default, natural calamities, or any other event of any nature or kind whatsoever beyond the control of LaurenAnn that directly or indirectly hinders or prevents LaurennAnn from performing its obligations.

Our Liability

We make every possible effort to make sure that we provide complete, accurate, and up-to-date information on our website. However, information may occasionally be incomplete, obsolete, or inaccurate. Therefore, LaurenAnn does not guarantee the accuracy of the Information. Moreover, to the extent permitted by applicable law, LaurenAnn disclaims all representations and warranties, express or implied, that the information on the Online Store is accurate, complete, up-to-date, and/or does not violate any third party’s rights. 

In case of an event that’s beyond our control or couldn’t be anticipated, we no longer have an obligation to fulfill a contract with you or compensate you for any damages. Such events may include:

• Government action or omission
• New legislation
• Labor law conflict
• War or danger of war
• Major disturbances of public order
• Sabotage
• Extreme weather conditions
• Fire or explosion
• Pandemics, epidemics, or viruses
• Natural disasters.

LaurenAnn is not liable for any damages, which are not reasonably foreseeable, arising out of or in connection with these Terms or your use of the Online Store.

Here, you agree to indemnify and hold harmless LaurenAnn and (as applicable) its parent, subsidiaries, affiliates, third parties, and their respective shareholders, officers, directors, agents, and employees, from any losses, liabilities, damages, costs, and expenses, claims or demand, or actions including reasonable attorneys' fees asserted against or incurred by LaurenAnn, made by any third party arising out of your breach or non-performance of the Terms, or your violation of any law, rules, or regulations or the rights of a third party.

Nothing in these terms shall exclude or limit LaurenAnn's liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.

LaurenAnn is not responsible for indirect losses which are a side effect of the main loss or damage. For example, loss of profits, loss of opportunity, failure to deliver the goods or meet any other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident, and terrorist activity.

Our maximum liability for any loss or damage arising in relation to your order shall be limited to the total price of your order.
